…Dismisses 3 separate appeals against his election
The Supreme Court on Friday affirmed the election of Governor Sheriff Oborevwori of Delta State as duly elected on March 18, 2023 general election in the state.
Apex Court in an unanimous judgement delivered by Justice John Inyang Okoro dismissed the three separate appeals filed by All Progressive Congress, APC, Social Democratic Party, SDP, and Labour Party ,LP challenging the election for lacking in merit.
Supreme court upheld the concurrent decisions of Delta State Governorship election tribunal and Court of Appeal Lagos Division which held that the petition filed by former Deputy Senate President Omo- Agege contained unsubstantiated allegations, noting that it was speculative and devoid of merit.
Supreme Court had on Tuesday reserved the Judgement in the appeals by the SDP, Labour party and the APC.
The Independent National Electoral Commission, INEC, had declared that Oborevwori of the PDP who polled 360,234 votes was the winner of the governorship election and defeated Omo-Agege of the APC, who secured 240,229 votes.
Other members of the five-member panel of the apex court, Justices Uwani Abba- Aji, Lawal Garba , Tijani Abubakar and Emmanuel Agim agreed with the judgement of Justice Inyang Okoro, in their separate judgements that Omo -Agege , Labour Party and the Social Democratic Party , SDP, were devoid of merits
Recalled that three member panel of justices of Court of Appeal headed by Justice C.H. Ahuchaogu had in a unanimous judgement last November affirmed Gov Oborevwori election and dismissed the appeal filed by former Deputy President of the Senate, Ovie Omo-Agege.
Not satisfied the appellants had approached the Supreme Court and urged the panel to invalidate the November 24 judgement of the Court of Appeal in Lagos State, which dismissed their case for want of merit and affirmed Oborevwori of the Peoples Democratic Party, PDP, as the bona fide winner of the governorship contest.
The tribunal held that the petition contained unsubstantiated allegations, noting that it was devoid of merit and speculative.
