The Department of State Security Services (DSS) has approached the Court of Appeal Abuja Division praying it to reverse the bail granted 12 associates of Sunday Igboho the Yoruba Nation’s agitator by the Federal High Court.
Justice Obiiora Egwuatu of the Federal High Court who granted the bail to Igboho associates, on Tuesday struck out DSS application with similar prayer like the appeal filed by Mr Idowu Awo the DSS lawyer.
The judge struck out DSS application after a dramatic withdrawal of the application in which the DSS had sought to further detain the associates of Igboho.
At the resumption of the matter on Tuesday, Awo stunned the court as he announced his decision to withdraw the application.
Awo told the court that instead of going ahead with the said application, he would pursue an appeal he had filed challenging the bail granted the four of the 12 detainees .
Justice Egwuatu consequently struck out the motion as the detainees lawyer Mr Sunday Adebayo did not oppose.
In the notice of appeal dated August 13, 2021, DSS had faulted the bail granted to Amudat Babatunde, Abideen Shittu, Jamiu Oyetunji, and Bamidele Sunday.
The security agency prayed the Court of Appeal, Abuja division to set aside the bail and allow it to carry out further interrogation of the detainees to determine the level of their complicity in the alleged stockpiling of arms and ammunition.
The four detainees were admitted to bail in the sum of N10 million each with two sureties in like sum, while the remaining eight were granted bail in the sum of N5 million with two sureties each.
Those admitted to N5 million bail are; Abdulateef Onaolapo, Tajudeen Erinoye, Diekola Jubril, Ayobami Donald, Uthman Adelabu, Oluwafemi Kunle, Raji Kazeem and Bamidele Sunday.
The court had ruled that one of the sureties must be an employee of the federal government on grade level 12 and above.
All the sureties who stood for the four detainees are resident in Abuja and they owned properties. As at Tuesday, while the four who the DSS want to further detain have secured their bail , eight others still have problem getting the required sureties.
