The Court of Appeal Abuja Division on Wednesday affirmed the election of Senator Abba Moro of the Peoples Democratic Party, PDP, as the elected Senator representing Benue South Senatorial District.
In a unanimous judgement a three man panel of the appellate court held that the appeal filed by Daniel Onjeh the candidate of the All Progressive Congress (APC) lacked merit and the panel consequently dismissed it.
The Court of Appeal resolved all issues raised in the appeal against the appellant on the ground that the.appellant was unable to prove that the result of the election held on February 25,2023 was falsified.
The appellant also failed to provide evidence that Abba Moro did not scored the lawful of majority votes cast during the election or that the votes accredited to him was unlawful.
Court of Appeal also said that the appellant allegations that Senator Moro was not qualified to contest the election, having allegedly presented a forged birth certificate to INEC was not proved.
Neither was his allegations of noncompliance with the Electoral Act 2022 (As Amended) and other irregularities complained of proved by the appellant the three-man panel of Justices of the Court of Appeal: Justices A. O. Otisi; O. Obaseki, and Justice A. M. Lamido held.
